PROTECTING YOUR DATA IS IMPORTANT TO US

Would you like to know what we do to protect the privacy of your data? We will explain all the details here. In principle, storing and using your data is subject to your consent. Or legal approval. This depends on what we do with your data.
Protecting your personal data is of utmost importance to us. We therefore take great care in processing it in compliance with the applicable laws on data protection and postal law. This privacy statement explains the methods we use to process data.
In this document, "MPS" refers to all MPS Micro Precision Systems AG entities, including MPS Microsystems, MPS Watch, MPS Décolletage entities, and also MPS Precimed SA.

  1. INTRODUCTION
    The abbreviation "GDPR" is used here as a short form for the EU General Data Protection Regulation. The following information serves to fulfil the information obligations for areas in which MPS as the responsible party collects, processes or uses personal data, in a transparent form.
    This document implies all MPS websites and e-shops (online shop):


    As a supplier or a service provider, we collect and process data during access or navigation (visit), when a user connects to the MPS e-shop (hereinafter: "Login"), when using the application and services offered on the Internet (hereinafter: online services). The above mentioned offers are hereinafter referred as “Digital presence”. In accordance with Art. 13 (or Art. 14) of the GDPR, MPS informs data subjects about the detailed circumstances of the collection and use of personal data. This is for transparency reasons. The information is structured as follows in the form of :

    • General information, regardless from which target group you as the data subject are
    • Targeted disclosures from MPS, depending on which target group you belong to. Each target group has a separate section below


    Our Digital Presence may contain links to other digital solutions outside of our control which are not covered by this privacy statement. If you gain access to other digital solutions using the links provided, the administrators of these digital solutions may collect information from you which they will use in accordance with their own privacy policy, which may differ from ours.

    4. Other information
      If MPS intends to process the personal data for a purpose other than that for which the personal data were collected, MPS shall make information about this other purpose and all other relevant information available to the data subject prior to such further processing. Separate information is not necessary if the other purpose is compatible with the previous purposes for which legitimacy was given or if the legitimate interests of MPS outweigh the former.

    5. Application
      This document applies to people who come into contact in some way or the other with MPS. Such a contact may include a direct exchange, a phone call, a mail, an email, an interface or through our digital presence (websites, e-shop, newsletter). These people agree to the terms and conditions mentioned in this document.


  3. ONLINE - COLLECTION AND USE OF DATA

    1. General information
      By using our Digital Presence, you consent to the collection, use and disclosure of the data in accordance with this privacy statement. In principle, you can use our Digital Presence without having to provide any personal data. As is common practice, we temporarily store your anonymised IP address in order to find and correct technical errors.
      Everything else is up to you, i.e. what information you wish to share with us. To do this, adapt the appropriate settings for cookies or for your account in the customer portal and in the community.
      Collecting data helps us to develop and improve our Digital Presence and to optimise our service offers. We use the data we collect for the following purposes:

      • To enable you to use our Digital Presence (establish a connection)
      • To manage the website internally, in particular for technical administration and system security
      • To optimise user friendliness, we collect statistics on user activity with regard to our Digital Presence. The data collected is analysed anonymously (see also 3.2.2).
      • To make the e-shop and Online Services available in accordance with the agreement
      • To tailor our website to the target groups (by means of targeted information or content which may interest you)
      • To prevent fraud and improve website security


      As well as for other purposes, in accordance with the agreement, the corresponding conditions of participation or the general terms and conditions of sale and delivery (GTC).

      Details on the specificities of our e-shop
      To use of some of our Online Services, you must first register with the e-shop by entering your personal information. The services are used in accordance with the agreement and the corresponding conditions of participation or general terms and conditions of sale and delivery (GTC). Other than that, we will only process your personal data when you send it to us, for example by filling out an online form or sending us a message via our contact forms.
      In such cases, we will only ask you to send us the personal data needed to provide the services offered. The data provided to us is logged on our IT systems.


    2. Cookies policy

      1. What is a cookie?
        Like many other websites, we also use so-called "cookies". Cookies are small text files that are transferred from a website server to your hard drive. This automatically provides us with certain data such as the IP address, browser used, operating system via your computer and your connection to the Internet. Cookies cannot be used to start programs or to transmit viruses to a computer. Based on the information contained in cookies, we can make navigation easier for you and enable the correct display of our web pages.
        Enabling cookies does not present a security risk.

      2. Use of cookies
        Under no circumstances will this data collected by us be passed on to third parties or associated with personal data without your consent.
        We use cookies to perform anonymous analyses of general user behavior with a view to optimising our Digital Presence. We use various web analytics services, such as Webtrends, an analytics service of Webtrends Inc. or, for a range of applications, Google Analytics, an analytics service of the Google Inc. network. Web analytics services use cookies which evaluate the use of our Digital Presence to obtain information for the purposes of improving our services and performing a statistical analysis of the visits to our websites. It is not possible to identify specific individuals. Information generated in this way may be transmitted to a server located abroad and stored there.         Analysis are carried out in order to optimize our digital presence. Our objective is greater ease of use and more intuitive location of content, which we intend to develop and structure more clearly. We hope to make our Digital Presence more user friendly and tailor it to your needs. This will enable us to optimise our website by offering you targeted information or content which may interest you.

      3. Disable or prevent the use of cookies and web analytics tools
        Of course, you can also view our website without cookies. Internet browsers are generally set to accept cookies. You can disable the use of cookies at any time via the settings of your browser. Please use the help functions of your Internet browser to find out how you can change these settings. Please note that some features of our website may not work if you have disabled the use of cookies.
        You can prevent cookies from being stored by adjusting your browser settings. Whether cookies can be stored and retrieved can be determined by the settings in your browser. For example, you may disable the storage of cookies altogether, restrict it to certain websites, or configure your browser to automatically notify you when a cookie is about to be stored and ask for your confirmation.         Data collection and storage can be withdrawn at any time with effect for the future.


    3. Use of YouTube components
      On our website we use videos from YouTube, LLC 901 Cherry Ave, 94066 San Bruno, CA, USA, a company of Google Inc, Amphitheatre Parkway, Mountain View, CA 94043, USA.
      When you visit a website with YouTube content, a connection to the YouTube servers is established and the content is displayed on the website by notifying your browser. For our part, we thus know which pages of our website you visited.

    4. Use of Google Analytics
      This website uses Google Analytics, a web analytics service provided by Google Inc. (follows as "Google"). Google Analytics uses so-called "cookies", text files that are stored on your computer and which allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. As a result of IP anonymisation enabled on this site, Google will truncate your IP address beforehand within member states of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and Internet usage to the website operator. The IP address provided by your browser as part of Google Analytics will not be merged with other Google data.
      You can prevent the storage of cookies via a corresponding setting of your browser software; however, please note that if you do this, you may not be able to use all the features of this website to the fullest extent.     5. Data protection in MPS portals (online shop)
      Are you signed up on our portal (e-shop)? And would you like to talk to us and others about products, services or order processing? We use your personal data for this purpose:
      When you create a user account, you can enter your information. In addition, we may request mandatory information from you. These are, for example, your first name, last name and your e-mail address. Should further data from you be displayed in the service portal, then this is data that we are already familiar with from the ongoing project.
      Do you want to delete your personal data from the portal? Please contact us by e-mail to dataprivacy@remove-this.mpsag.com stating your name and a request to delete your portal user access.

    6. Data protection for your newsletter subscriptions
      Are you currently subscribed to the MPS Micro Precision Systems AG newsletter or to one of our units (MPS Watch, MPS Microsystems, MPS Décolletage, MPS Precimed) ? Then you are receiving regular technical information on our innovative miniature and micro drive systems as well as the latest news about MPS. You only receive this information if you have requested it personally.
      We use your personal data for newsletter subscriptions as follows:

      • Mandatory: name, e-mail address
      • Optional: company name, first name, country


      We need these mandatories information to check whether you have personally requested the newsletters and whether you agree to receive this information. If you agree and have confirmed this by clicking, we send you the desired newsletters addressed to you personally based on your data.
      Further data can be provided voluntarily by you. We use this data to send the information requested by you as well as in the context of satisfaction surveys, in order to send you suitable and tailored information on the topics you are interested in or have enquired about.
      You can unsubscribe at any time directly from your newsletter by clicking on "Unsubscribe" or by sending us a request by e-mail. You may also withdraw your consent in perpetuity under dataprivacy@remove-this.mpsag.com.


    7. Data protection for all requests & enquiries (information, offers, ...)
      Do you have a specific enquiry for MPS? Then you will receive the desired information within the scope of your enquiry. To process your enquiry, it is necessary that you provide further data. We use your personal data for your request as follows:

      • Mandatory: Company name, first name, last name, e-mail address, country
      • Optional: address, postal code, city


      Mandatories information are required to process your request. You may provide further information voluntarily.
      We use your data to render the services requested by you as well as in the context of regular satisfaction surveys and/or service calls (also by third parties), in order to send you suitable and tailored information on the topics you are interested in or have enquired about.


    8. Electronic communication
      E-mails and forms sent via the internet are neither confidential nor secure and may be viewed and amended by third parties. MPS shall not be liable for any damage resulting from messages sent to you via non-encrypted e-mail or other messages sent to you electronically (SMS, etc.).

    9. Will we share your data with anybody?
      If MPS involves third parties in the provision of its services, it is entitled to make the data required for that purpose available to them; the third parties shall be subject to the same obligations as MPS with regard to data protection. Otherwise, personal data is not communicated to third parties or otherwise transmitted without your express consent. We will retain your information for no longer than necessary and treat it confidentially. This excludes personal data transmitted to public authorities and agencies and to private persons with a right thereto in accordance with legal provisions, court orders or injunctions issued by authorities, and data transmitted to authorities for the purposes of taking legal action or prosecution in the event of an infringement of our legally protected rights.

    1. The purpose of collecting, processing and using the data
      It is the processing of your application, examining it for suitability and establishing contact.

    2. Legal basis for processing (Art. 6 GDPR)
      Implementation of (pre-)contractual measures carried out at the request of the data subject or consent to the processing specified in the respective agreement.
      In principal, MPS observes the requirements of data prevention and data minimization relevant to the intended purposes of processing, taking into account the interests of the data subjects deserving protection.

    3. Description of the groups of persons concerned and the relevant data or data categories
      Affected group of persons: Persons applying for a job at MPS. The usual and necessary details of applicants for application procedures are collected and processed.

    4. Recipients or categories of recipients to whom the data may be communicated
      All MPS employees who are authorised to perform the specific tasks internally. External contractors as subcontractors within the meaning of Art. 28 GDPR. Accessing personal data is generally not the purpose of the assignment, but it cannot be excluded.

    5. Data transmission to third countries
      Data transfers between MPS companies in third countries only occur within the scope of fulfilling the contract. If MPS itself subcontracts in the event of processing an order, these subcontracts are secured through data protection contracts. Corresponding audits take place regularly.     6. Storage period or standard periods for the deletion of data
      The legislator has enacted a variety of storage obligations and periods. After expiry of these periods, the corresponding data is routinely deleted if it is no longer necessary for the fulfilment of the contract. Thus, in accordance with legal regulations, the commercial or financial data of a closed financial year is deleted after a further ten years, unless longer retention periods are prescribed or required for legitimate reasons. Shorter deletion periods are used in special areas (e.g. in personnel administration such as rejected applications or cease and desist letters). If data are not affected by this, they are deleted when the purposes for which they were stored cease to apply.

      Depending on the phase of our contact, different legal bases for the processing of your data are conceivable:

      • Implementation of (pre-) contractual measures pursuant to your request (this can also be, for example, the registration of your contact data from your business card after a trade fair visit) or consent to processing specified in the respective agreement... (for example in the form of a declaration of consent by e-mail)
      • Processing is necessary to fulfil contractual obligations (e.g. for MPS services)
      • Possibly also for the protection of the legitimate interests of MPS


      In principal, MPS observes the requirements of data prevention and data minimization relevant to the intended purposes of processing, taking into account the interests of the data subjects deserving protection.

      Affected groups of persons: business contacts of MPS; such as contact persons of customers, service providers, partners.
      The usual and necessary details of the contacts (last name, first name, salutation, company affiliation, if necessary department, telephone number, e-mail address) are processed.

    4. Recipients or categories of recipients to whom the data may be communicated
      All MPS employees who are authorised to perform the specific tasks internally. In the case of payment transactions, credit institutions are provided with the necessary information. External contractors as subcontractors within the meaning of Art. 28 GDPR. Accessing personal data is generally not the purpose of the assignment, but it cannot be excluded.

    5. Data transmission to third countries
      Data transfers between MPS companies in third countries only occur within the scope of fulfilling the contract.     1. Right of access and information
      If you have any questions about the processing of your data, you can contact us under dataprivacy@remove-this.mpsag.com.
      If you would like to contact us by e-mail, please note that e-mails are not encrypted and are therefore exposed to the security risks typically associated with that means of communication.

    2. Correction, erasure and blocking/withdrawal of consent
      If you want your data to be corrected, blocked or erased, you can contact us in writing, enclosing a copy of your passport and ID card, at the at the company address or by e-mail at dataprivacy@remove-this.mpsag.com. If the deletion of such data is not permitted by law or by the agreement, or in accordance with the provisions of fiscal and commercial law, in particular with regard to the statutory retention periods, the data will be blocked rather than deleted.


  7. COPYRIGHT AND TRADEMARK RIGHTS
    All the content of the Digital Presence is protected by copyright (all rights reserved). Downloading or printing individual pages and parts of the Digital Presence is permitted for private use only and not for commercial purposes, provided that the copyright notice or other legally protected elements are not removed.
    The reproduction, transmission (electronically or otherwise), modification or linking of the MPS website for public or commercial purposes is prohibited without the prior written consent of MPS.
    The name "MPS" and other product or service designations (including logos) are registered trademarks of MPS. No aspects of the Digital Presence are designed in such a way as to grant the use of those trademarks.

  8. DISCLAIMER
    MPS does not assume any liability for disruptions in the function of the Digital Presence or for the presence of errors. MPS does not guarantee that issues will be resolved or that the Digital Presence and the associated server are free of viruses or harmful components.
    MPS does not assume any liability for damage resulting from access to or use of aspects of the Digital Presence (or from the inability to gain access to or use them, or from viruses, etc.).
    Although MPS takes great care to ensure that the information available on the Digital Presence is accurate at the time of publication, neither MPS nor its contractual partners guarantee their accuracy, reliability or completeness. The information and opinions published on the Digital Presence may be amended at any time without prior notice.
    MPS will not test the websites linked to its Digital Presence. It does not assume any liability for their content or for the products, services or offers they contain.

  9. APPLICABLE LAW/FORUM
    To the extent admissible by law, all legal relationships between the users of the Digital Presence and MPS shall be subject to Swiss substantive law. The sole place of jurisdiction is Biel/Bienne.

    Occasional changes to this privacy statement may be required, for example owing to the development of our Digital Presence or changes in legislation. MPS therefore reserves the right to amend the privacy statement at any time with effect at a later date. Accordingly, we recommend that you re-read this privacy statement on a regular basis.
